Draft law: Private firms cannot issue parking fines

Only municipal traffic wardens and police should have the authority to issue parking tickets, according to a proposal by a Justice Ministry working group. If passed, this law could put private parking companies out of business.

The legal standing of parking fines issued by private firms has aroused much debate over the past couple of years, with conflicting edicts coming from parliament’s Constitutional Law Committee, the Supreme Court and various legal experts.

A Justice Ministry working group now proposes to restrict the right to issue parking fines to public authorities. In future, private parking companies would only assist the authorities and be subject to a licence.

Money derived from fines would go into municipal and state coffers.

The proposal will be circulated for comment within the Ministry of Justice until just before Midsummer. Should it be enshrined into law, the new legislation will come into force on March 1, 2013.
